    While some major companies, such as Lehman Brothers Holdings Inc., Tribune Co. and Circuit City Stores Inc., filed for bankruptcy protection from creditors in 2008, there are a lot more companies quietly scrambling to set their finances straight in the hopes of avoiding bankruptcies, lawyers in the area say. While some may succeed, the pipeline of those likely to fail is growing, they say.

    The report by Alvarez & Marsal says the quick filing destroyed $50 billion to $75 billion in Lehman value. Delaying the bankruptcy filing by a few weeks would have allowed Lehman to transfer or unwind its derivatives trades and preserve more cash for creditors, the report concluded. A delay also would have allowed Lehman to sell assets before the bankruptcy depressed their prices, Alvarez & Marsal co-chief executive Bryan Marsal told the Wall Street Journal.

    Photographer Duane Kerzic was standing on the public platform in New York's Penn Station, taking pictures of trains in hopes of winning the annual photo contest that Amtrak had been running since 2003. Amtrak police arrested him for refusing to delete the photos when asked, though they later charged him with trespassing.

  • House Passes “Ledbetter” Fair Pay Act But Too Soon to Declare Victory
    In a close vote of 225 to 199, today the U.S. House of Representatives passed the Lilly Ledbetter Fair Pay Act of 2007. It's not surprising that the bill passed, because it simply re-states the law as it has been interpreted for many years. What is truly shocking is that 199 members of the House voted to roll back our rights and deprive women of this longstanding remedy for pay discrimination.

    In 2002, the administration considered submitting the Treaty of Moscow, a nuclear arms reduction agreement, for majority approval of Congress. Vice President-elect Joe Biden, who was then the chairman of the Senate Foreign Relations Committee, privately made clear that he would vigorously oppose such an attempt to evade the Senate’s constitutional prerogatives. The administration agreed to submit the agreement as a treaty, and the Moscow agreement cleared the Senate.

    Murals of the Statue of Liberty have appeared on hi-rise buildings throughout Los Angeles. City officials in Los Angeles have cited the artist and have threatened to file criminal charges.

    Councilman Jack Weiss who represents West Los Angeles and Hollywood, stated the city should file charges against McNeilly. "People shouldn't be doing this. And the city attorney should go after them aggressively and throw the book at them," he said, according to David Zahniser in the Los Angeles Times, Jan. 1, 2009.

    In addition to the card-check provisions, employers should be aware of another part of EFCA that may prove equally challenging. EFCA allows a company and a union only 90 days to negotiate a first-time collective bargaining agreement. If they are unsuccessful after 90 days, either party can demand mediation. If after 30 days mediation proves unsuccessful, a contract will be imposed on the company and the union by a third-party arbitrator in a process called “interest arbitration.”
