“Justice delayed is justice denied.” Exactly. And the current filibusters are a historical anomoly. Democrats are obstructing nominees on every bench suffering a “judicial emergency.” “The Senate is falling down in its responsibility to fill these emergencies.” More than 4,100 cases in the 9th circuit are effected by this delay–there is a 36 month wait for trial.

Surprising that Kyl’s even here, given the amount of time that he’s been spending on the Medicare conference (coming out tomorrow or Friday, most likely).

Kyl hits the “Mr. Smith” angle. As pointed out in the link above, it’s easier to obstruct than to push business forward. That’s why the Democrat filibuster works. Also, Kyl draws the distinction between legislative and executive matters–very important, as the framers seem to have intended for a “simple majority to prevail” (as Kyl puts it) in executive appointments.
